Powers of Attorney Solicitors | Grays, Thurrock, Essex

MPR Capron have significant experience in the drafting of Lasting Power of Attorney ( LPA ).

An LPA is a legally binding document which gives authority to a selected person or persons should you become unable to manage your own affairs due to accident, illness or a loss of mental capacity.

If a LPA is has not been arranged and you become mentally incapable of managing your own affairs then an application has to made for a Deputy to be appointed. This is then an appoinment made by the Court of Protection and may not be the a person who you would have wished to now manage your affairs. The process of having the COurt of Protection appoint a Deputy is also significantly longer and more expensive than appointing an Attorney using an LPA.

Please also bear in mind that an LPA can only be granted whilst an individual has full mental capacity.

LPA come in two different types:

Lasting Power of Attorney – Health & Welfare

This is where an individual appoints someone to make decisions pertaining to their personal welfare ( medical care & living arrangements) or any treatments for ongoing medical conditions.

Lasting Power of Attorney – Property & Financial Affairs

This involves appointing an Attorney on your behalf to oversee and make decisions relating to financial matters. This can often involve the paying of bills, collection of pensions and benefits, handling of bank accounts and the management of property and investments held by the applicant.
